Usage Rights: Any limits, terms, and restrictions that we may impose from time to time, at our sole discretion, will apply to your use of the Services. Any component of the Services, including the availability of any service feature or material, is subject to change, suspension, or discontinuation at any time. Without prior notice or responsibility, we may also place restrictions on specific features and elements of the Services or deny you access to all or part of the Services.

Length of and End of Agreement: During your use of our services, this agreement will be in full force and effect. Your user account may be terminated by us at any time and for any reason. You will not receive a refund for any money you paid for the services if we close your user account due to a violation of this agreement.

Information and Observation: Whether or not our team monitors and/or removes content from the services, each user is ultimately accountable for the content they post while using the services. You acknowledge that we may monitor and remove from the services any content in a user’s or member’s greeting and/or message related to that user’s or member’s use of the services if, in our sole discretion, we determine that such content is attacking, unlawful, appears injurious or hostile to another user or member, or infringes upon the rights of another user or member or the terms and conditions of this agreement. We reserve the right to intermittently review all posts, communications, and auditory and video recordings to make sure they hold to any valid content regulations. You recognize that by using the services, you might come across content—which could contain explicit or graphic language—that some individuals may find offensive, crude, or intolerable.

Charges and Disbursements: Users must purchase minutes using any credit card exhibiting a Visa, Mastercard, or Discover logo online at the internet site or by calling the number supplied on the website to access the services. Other payment methods won’t be accepted. Prepaid minutes that aren’t consumed will stay in the user’s account for a full year before becoming inactive. Any unused minutes will be immediately and automatically surrendered if your use of the services is discontinued due to your violation of this agreement or for any other reason determined by proprietorship & administration. One member cannot transfer minutes or pre-paid time to another participant.

You also are responsible for any fees or charges incurred to access the services, including but not limited to telephone charges, long-distance charges or mobile phone charges including messaging and/or data charges.

CHARGEBACKS: If you request a chargeback through your credit card company, we will dispute it and give them all crucial information to prove you did in fact use the service. You will also incur a charge of $45 per chargeback item. For example, if you placed two calls and chargeback each one, you will be charged $45 times two. If you request a refund of any unused funds, we do reserve the right to deduct credit card fees from that refund.

REFUNDS: refunds are approved on a case-by-case basis. Please create a support ticket, or email darkcommunications@gmail.com to get approval on any refund for a call. We will listen to your logic and make the determination accordingly.

Privacy and Use of Information: By using the services you have agreed to our privacy policy. You acknowledge that the company cannot ensure the security or privacy of data you provide through the Internet and email, or while using the services, and you release us from any and all accountability in connection with the use by other parties of the information you provide; the company is not liable for, and cannot control, the use by others of any information which you provide while using the services and you should use caution in choosing the personal material you provide to others through the services; while any auditory and audiovisual recordings of other users or members is forbidden under this agreement, some users or members may violate these limitations and make recordings of you and/or any information that you may provide, and you release the company from any and all liability in connection with the use of any such recordings by other parties; and the company cannot shoulder any responsibility for the content of messages left by other users or members of the services, and you release the establishment from any and all liability in connection with the content of any telecommunications you may receive from other users or members.

Removal of Information: While we do not and cannot evaluate every message or other material sent by user, and are not liable for any content of these messages or materials, we reserve the right, but are not beholden, to delete or remove messages or materials that we, in our sole discretion, deem to violate the terms of this agreement or any pertinent content guidelines, or to be otherwise unacceptable by us.

Proprietary Information: The services contains information which is proprietary to us, our partners and our users. To the extent possible, we assert full copyright protection in the Services. Information posted by us, our partners, or our Users may be protected whether or not it is identified as proprietary to us or them. You agree not to modify, copy, or distribute any such information in any manner whatsoever without having first received the express authorization of the owner of such information.

External Links: The website may from time to time contain links to other Internet sites and resources. You accept that we are not liable for, and have no liability for the availability of external links or their contents.

Indemnity: You agree to indemnify us, our officers, managers, workers, and agents, from any loss or damages, including without limitation realistic legal fees, which we may suffer from your activities on or use of the services, including without limitation any breach by you of this agreement, including but not limited to any charges or grievances made by other parties against you. You shall collaborate as fully as reasonably required in the defense of any claim. We reserve the right to assume the absolute defense and control of any matter otherwise subject to indemnification by you; provided, however, that you shall remain liable for any such claim.

No Warranties: You accept that use of the services is at your own risk. We are not liable for any conduct of, or incorrect or inaccurate content or other information communicated by, a member or user of the Services.
